FYI : use of "Inkscape" TM by other company

Postby Loda » Mon Apr 08, 2013 10:26 pm

I saw this project called "inkscapes" by http://adrianavarro.net/
http://www.fubiz.net/2013/04/04/inkscapes/

I thought you want to know about it. To see if it is an infraction of your TM or (R).

PS: If you don't care: sorry, just erase my post.

It appears (to me) that project is called "Inkscapes", and not related to vector graphics.

Inkscape is an open source (vector graphics editor) project, released under.....let's see if I can say it right this time, lol....GNU General Public License, which can be found in Help menu > About Inkscape > License tab. You might be interested to read the whole thing. Although personally, I get bogged down in some of the terminology.

From previous discussions (held in this forum, please feel free to search) I've learned that under Inkscape's license, someone could even package and sell Inkscape, if they wanted to, as long as they document everything, and also make it publicly available. (I just know someone's going to have something to say about my terminology there. But that's my understanding.)

Now whether someone else could use the word "Inkscape" as a title for their project....well, I suspect that's ok. I don't think word "Inkscape" is copyrighted or trademarked. In fact.....and I could be really wrong about this part, but I think Inkscape's license prevents anyone copyrighting it.

Plus the Inkscapes project appears to be a collection of artwork, described on that website as "an interactive drawing performance". (It sounds very interesting, and if I had time, I'd like to read more about it. But I just don't have time right now.) Inkscape is a vector graphics editor, while Inkscapes is a collection of interactive drawing performances. The only thing they really have in common is art. I would make a very simplified analogy, where someone does a study of different varieties of apples, let's say in oils, and they call the whole collection "Apples". Yet the popular (though outdated, I guess) brand of computers and related products sold under the Apple license (whatever it is) aren't concerned about it.

Of course, others are much more knowledgeable than I am. But based on what I understand about Inkscape's license, it's probably not a problem for that artist to use "inkscapes" to title his drawing performances

Off topic:
What's with inkscape's "branding"? Is it all OK with paramount?

Maybe you better ask yourself to that company, for their trademark safety.
